Terms and Conditions

These terms and Conditions relate to all orders placed through Jual Furnishings Ltd Direct. 

Should you chose to use Our Recommended Retailers they will have their own Terms and Conditions in place and are completely seperate to Jual Furnishings Ltd.

General
(a) Unless otherwise agreed these Conditions shall apply to all business conducted between Jual Furnishings Ltd and the Customer overriding any terms and conditions stipulated, incorporated or referred to by the customer in his order or negotiations.

(b) Jual Furnishings only carry out business in accordance with these Terms and Conditions and any orders received or accepted are only undertaken subject to the adoption of these clauses and to the exclusion of any conditions not in the agreement therewith.

(c) Acceptance by the Customer of the quotation or the giving of instructions to Jual to proceed with any work shall amount to acceptance by the customer of these terms and conditions.

(d) Orders are only accepted on the understanding that goods are invoiced at the price-ruling at the date of dispatch, unless specifically agreed otherwise in writing.


Delivery and Terms of Payment 
(a) The price shall be Jual’s quoted price. The price is inclusive of VAT which shall be due at the rate ruling on the date of Jual’s Invoice.  Payment must be made before the goods are delivered. Price includes delivery to UK Mainland with exception to Highlands and Grampians and listed postcodes on our Delivery Information whereby a delivery surcharge will apply.

(b) We shall deliver the goods to the address the Customer specifies for delivery on the order. It is important that the address is accurate. We cannot accept any loss or damage to the goods once they have been delivered in accordance with your instructions (unless this is caused by our negligence). We aim to deliver the goods by the date quoted for delivery but delivery times are not guaranteed. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we will contact the customer to arrange an alternative time. 

(c) All goods remain the property of Jual Furnishings Ltd until they are paid for in full.

(d) It is the customers responsibility to pay any custom charges that may be incurred with deliveries outside of the UK.


Acceptance of the Goods 
(a) The Customer shall be deemed to have accepted Goods 14 days after delivery to the Customer 

(b) After acceptance the customer shall not be entitled to reject Goods which are not in accordance with contract

(c) No goods delivered to the Customer which are in accordance with the contract will be accepted for return without prior written approval from Jual on terms to be determined at the absolute discretion of Jual. A charge will apply for any goods that are returned for any reason other than manufacturing faults.

(d)Goods returned without the prior written approval from Jual may at their discretion be returned to the Customer or stored at the Customer’s cost without prejudice to any rights or remedies Jual may have. 



Warranty 
(a) Jual will warrant that as from the date of delivery for a period of 12 months the goods and all their component parts, where applicable are free from any defects in design, workmanship, construction or materials. 



Rights to Cancel 
(a) We reserve the right to cancel the Agreement between us if: 
      a1. We have insufficient stock to deliver the goods you have ordered 
      a2. We do not deliver to your area; or
       a3 One or more of the goods you ordered was listed at an incorrect price due to a typing error.
(b) Should the Customer cancel the order of goods after the order is placed they will be liable for any costs incurred.


Liability 
(a) Except for death or personal injury caused by our negligent acts or omissions we shall only be liable for any loss or damage which is a reasonably foreseeable consequence of a breach of this Agreement.
(b) You will be responsible for all claims, liabilities, damages, costs and expenses suffered or incurred by us as a result of your breach or default in the discharge of your obligations.
(c) In the event of our losing or damaging your goods, we will pay for the reasonable costs of the repair or replacement of the item or provide you with a refund in full.
(d) Nothing in this Agreement shall exclude or limit the Company’s liability for death or personal injury resulting from the Company’s negligence or that of its employees.
